I’m thumbing through the subject index of bills passed by the 2019 Florida Legislature, looking for changes in Florida business law, Florida real property law, and Florida wills, trusts and probate law. What do I find? What will become new law when (if?) the Governor signs it? When will it go into effect?
First I find HB 1009 that would amend Florida law regarding corporations, LLCs, and partnerships. It goes into effect January 1, 2020, if the Governor signs it. It’s 527 pages long. That’s a lot of changes. We’ll have some reading to do.
Next is HB 409 that regulates signing and storing electronic legal documents including, get this, wills. In a mere 78 pages, this bill could upend hundreds of years of the practice of signing and storing documents on paper. My law office has been paperless for ten years, but I’ve never prepared an electronic will. This should be interesting. I wonder if the Governor is ready to sign this one.
I guess we’ll just have to wait and see…
